    I’m really having a hard time understanding this. A dude picks up a toy gun that is FOR SALE at the same store. He never once ‘shoulders’ the gun. Imagine your surprise if cops showed up out of nowhere yelling at you. Would you have any idea what was going on? How did the cop feel so threatened for his life that he decided to shoot essentially sight unseen.

    I can’t believe the cop won’t even be fully investigated. This needs to be nationally reviewed.

    Beavercreek is a pretty backward place. It developed from a rural redneck community in the 70’s to a McMansion redneck community today, very republican white flight area. These are the same folks who tried to get the mass transit authority not to install bus routes and stops in the community to keep out the undesirables (read black folks). Dayton has a ton of problems and race in always right there in the center of the mess. Glad I got out when I did.

    Interesting Freepress article published before the grand jury failed to act. Seems the special prosecutor has a history of this sort of thing.

    Piepmeier has a long history with high profile controversy. He was the Assistant County Prosecutor who gained an indictment against Ken Roach, the Cincinnati police officer who shot 16-year-old Timothy Thomas in the back in 2001 while the unarmed teen was fleeing from a warrant for an unpaid seat belt violation. A jury later failed to convict Roach on charges of negligent homicide. It is not clear why Piepmier did not choose to prosecute Roach for murder.

    Piepmeier’s questionable past goes back further. Piepmeier is touted as being the tough “law and order” prosecutor who secured a heap of indictments, convictions and death sentences against key inmates as a result of the Lucasville prison uprising. The continuing appeals in those cases have revealed a pattern that appears as systematic prosecutorial misconduct.

    Murder. Pretty clear to me.
    They barely looked at him before they started firing.
    He was on the phone in the corner of what looks like a dog food aisle carrying a bb gun in a store that sells bb guns doing exactly nothing threatening.
    A badge is not a license to kill.

    (And Beavercreek is most definitely a backwards place…)

    WTF difference does it make? What bearing does that have on this case at all?
    Have you been to a Walmart before? You’ve never seen anything out of box for sale?
    Don’t Police generally say something before they kill you? Generally?

    If I were a retailer, I would stop selling toy (and real) guns.
