Injury at McDonald's

I have a friend who went to McDonald's the other day, and when biting into a burger felt a sharp pain in the roof of her mouth. It turned out to be a piece of wood, and they actually had to have EMS come remove it. McDonald's was nice enough to make the call to 911, however they were rather adamant that she give the piece of wood back to them. She refused, and so far that's the whole story.
Can anyone give decent advice on this? Should she take them to court for the cost of the EMS visit, or just hope that they'll reimburse her? I'm trying to give sound advice to her, but short of suing their asses I don't know what to tell to her. She has no insurance.

Start by sending the manager a copy of the bill (and a photocopy of the piece of wood, maybe next to a ruler or something for scale) with a letter explaining the situation and that she doesn't want to make a fuss, isn't one of those folks who loves taking things like this to the media, etc., but she doesn't really think it's fair that she gets stuck with the bill for this and would they please pay it. See where that goes.
(How big was this piece of wood, anyway? What necessitated a visit from the paramedics?)

I haven't seen it, but she describes it like half of a toothpick and it actually lodged up in the roof of her mouth, caused a lot of bleeding etc.
Edit: McDonald's suggested the EMS and I guess she agreed. Probably hysteria, maybe an over reaction. I dunno.

I'd be calling my Uncle who is a Personal Injury Lawyer and I'd be suing the crap out of McDonalds right now.

Suing someone for kicking your pregnant wife out of the pool, seems different to me than suing over an injury that happened to you because of someone elses incompetence.

Someone can't, actually. The appeals judge reduced the damages to about a fifth of the original amount. And... well. If anyone's interested, the facts are here. They're not nearly as entertaining as the "litigious old bat spills some coffee and sues for $2.7 million" version, though.

Why not?
You are probably equally as likely to have a shard of wood in your McDonald's burger as you are to win the Lottery. Probably more likely to win the Lottery.

Pain and suffering. That sounds REALLY f***in' painful. I am certain she suffered.
I wouldn't call that "winning".
Of course, millions of $ is probably not fair compensation either.

Its for the judge/jury to decide the amount in the end. I would make sure it at least got there instead of handing them a bill and going 'can you just pay this bill, i wouldnt want to force you into fixing whatever was wrong back there or wrong with your currently policies'.
Then next week someone can comment about how something worse happened to them... :(
