Steve Barbour Memorial Ride
When: Sunday, August 23rd, 2009
Start Time: Assemble at 8:30 a.m. Ride starts promptly at 9:00 a.m.
Where: Heritage Trailhead Parking Lot, Downtown Hilliard' OH
Refreshments Following Ride: Dutch Kitchen Restaurant, Rt. 42, Plain City -11:00 a.m.
We have been able to obtain a permit from the City of Hilliard to conduct a ride in memory of our friend, Steve Barbour, who died as a result of the injuries he sustained when he was hit by a drunken driver on Cemetery Road, July 18th, 2009. The ride, escorted by the Hilliard Police, will proceed from the Heritage Trailhead to Cemetery Rd. where we will have a short ceremony and where we will place a "ghost bike" in Steve's memory. The ride will turn around at the Hilliard Plaza Shopping Center and return to the trailhead. We encourage participants to join the family at the Dutch Kitchen on Rt. 42, Plain City, after the ride. You may ride to the Dutch Kitchen or drive. Steve's family, will host the event at the Dutch Kitchen.
Some suggestions have been made as to how we may best honor our friend. Here are just a few: Wear lights, both on your bike and on your person. Wear a jersey that best "connects" you to Steve, e.g., Dutch Kitchen jersey, TOSRV and any other that you wore while riding with Steve.
In the interest of safety and as good examples to the community, helmets are required and all participants should ride no more than two abreast.

If anyone has been wondering where this case went, the trial has started. The latest from the Dispatch:
A Licking County man accused of killing a bicyclist while drunk at 6 a.m. last July contends that police had no probable cause to arrest him and wants the breath-analysis test results tossed out of court before his trial.
Edward S. Miller, 29, of 77 Price Rd. in Newark, was arrested July 18 after Hilliard police said his pickup struck Steven Barbour shortly after sunrise on Cemetery Road.
Barbour, 58, died four days later. Well-known in local cycling circles, he had been en route to Union County from his Upper Arlington home to lead an organized bike ride.
Miller was indicted on charges of drunken driving and aggravated vehicular homicide. He has been free on bond.
His attorney, D. Timothy Huey, has challenged Miller's arrest and filed a motion to suppress evidence that his client had been drinking. A hearing began last month and continues Friday in front of Franklin County Common Pleas Judge Stephen L. McIntosh.
After the crash, Huey said, Miller was lucid and cooperative with police, did not slur his speech and walked without a stagger. Officer Douglas "Jack" Lightfoot did not properly administer field sobriety tests and questioned Miller without advising him of his rights, Huey said.
"Under the totality of the circumstances, Mr. Miller's appearance, behavior and performance on those tests are not indicative of impairment," Huey wrote in a legal brief.

"...A breath-analysis test given at police headquarters indicated that Miller had a blood-alcohol content of 0.109 percent..."
Wow, he was still that drunk by the time the got him to the police station.

The trial started last week and should wrap us this. Tragic case all the way around from my perspective. Maybe I am mistaken, but there is very little if anything to prove that Steve Barbour was or was not discernable at the time of the accident. Nonetheless, the .105 BA level of the defendant along with the particulars of having a local media personality in the car with him (fired over this-anyone would logically surmise) who were at a strip bar drinking BYO alcohol til 5:00 am would seeming almost guarantee a guilty verdict. I am an avid cyclist and knew of Steve Barbour. It is very tragic-beyond words-that he was killed. It is extremely unlikely he would ride eith carelessly or without his lights on as he was an incredibly careful cyslist. But nothing will bring him back and I have a problem with vengence and punishment if the evidence is marginal. I can only pray that the jury listens to the evidence and somehow refrains from letting the evidence of alcohol become the primary reason for convicting.Posted 2 years ago # -

Plea is reached in death of cyclist

Thursday September 15, 2011 4:14 AMNeither side wanted to endure a second trial in the case of Edward Scott Miller, accused of killing a bicycle rider on a Hilliard road in 2009 while driving drunk.
A jury had been seated and opening statements were set to begin yesterday afternoon when a plea agreement was reached in Franklin County Common Pleas Court.

Granville man sentenced to more than 3 years in prison for bicyclist's death

the judge could kick this guy loose after doing a few months,and stay under the radar.
