Texting While Driving Ban - News & Updates

I just wanted to remind everyone that the texting ban goes into effect today. It now becomes a primary offense to text while driving. The law does allow one to do so while stopped or pulled over though.

They did say on the radio that you would have to admit to doing it because they have to jump through a bunch of hoops to take your phone into possession to prove it.

Illegal or not, it's just not a good idea while moving.

Last two texters I saw where swerving down high going 10 mph.
Both had state issued plates.

I doubt this law covers bikers, as well? We were driving down High Street in Clintonville and there was a fellow on his bike texting and swerving into the street which, in turn, caused us to swerve to avoid hitting him. Though, I have to admit, I was quite amazed at his ability; I can barely take my hands of the handle bars for a second w/o it turning ugly. :)

Text of the Columbus City Code Texting Ban (CCC Ã‚Â§ 2131.44)
____________________________________________________________

CCC 2131.44: Sending, reading or writing a text message or accessing the internet while driving.

(a) As used in this section:
(1) Ã‚Â³Text messageÃ‚Â² means a message sent, stored or received via a mobile communication device. For purposes of this section, an e-mail message shall be considered a text message.
(2) Ã‚Â³Mobile communication deviceÃ‚Â² means any portable electronic device
capable of transmitting or receiving data in the form of a text message or capable of accessing the internet, including but not limited to a wireless telephone, a text-message device, a personal digital assistant, or a personal computer.

(b) No person shall operate a motor vehicle while using a mobile
communication device to
(1) Compose, send or read a text message; or
(2) Send, read, create, play or interact with internet-based content.

(c) Notwithstanding the provisions of division (b), this section shall
not be construed to prohibit the use of a mobile communication device inside a motor vehicle by:
(1) a driver using a mobile communication device to report a health or safety emergency, or
(2) a driver using a mobile communication device while the motor vehicle is parked, standing or stopped and is removed from the flow of traffic, in accordance with applicable laws or rules, or is stopped due to the inoperability of such vehicle; or
(3) a driver using a mobile communication device in the course of the
driverÃ‚Â¹s duties while operating an emergency or public safety vehicle.

(d) Whoever violates this section is guilty of a minor misdemeanor.

Moments ago I shouted "no texting!" to a woman at a stop light as she was typing away, she put her index finger in the air as if to say "just a moment" and then finished her text, then she looked at me and said "what?"

Amazing.

This makes me wonder if my navigation software that comes standard with my phone is prohibited because it is internet based content.

I use my phone to listen to Pandora while I am driving. It seems that forwarding past a track that I don't like would be prohibited too.

The wording is ambiguous with regard to that.

It seems like the following list would be accurate:
Send internet-based content
Read internet-based content
Create internet-based content
Play internet-based content
& Interact with internet-based content.

You would be playing internet-based content which would be in violation of the ban from my understanding of the law.

Legislation cropping up nationwide Ã¢â‚¬â€œ and in Columbus Ã¢â‚¬â€œ seeking to curb distracted driving appears to be making its mark, according to a new survey from Nationwide Mutual Insurance Co.

The Columbus-based insurer in an April poll of 1,005 adults nationwide found that 20 percent of drivers with cell phones admit to texting while driving. Of those who fess up, 40 percent say theyÃ¢â‚¬â„¢ve cut back from last year. Two in three adults surveyed say they talk on their cell phones while driving but 30 percent of those said theyÃ¢â‚¬â„¢ve curbed the habit from a year ago.

I have a friend who is addicted to her XM radio, and she will scroll through multiple stations and channels looking for music while driving. It's frightening.

If you just push a button, I suspect you will be OK. That isn't distracted driving. But if you are constantly checking your phone to look at the lyrics of the music, you may want to reconsider that. :)
