Lisa Hackley, spokeswoman for newly elected Ohio Attorney General Mike DeWine, declined to use the word “extortion†when describing 28-year-old Jonathan Kirk’s request for money last week, after Kirk was struck by a car in which DeWine was a passenger.
Kirk asked the AG’s office for compensation for missed work and a broken cell phone, despite the fact all parties agree Kirk was a fault for the accident. The request also came with Kirk’s threat to take the story to the press. The office declined his request.
“He was making a request for things that we are not responsible for,†she said Wednesday, adding that DeWine “wished Mr. Kirk well.â€Â
DeWine was a passenger in a car that struck Kirk, riding a bicycle en route to a meeting with his parole officer on Jan. 13. Kirk pleaded guilty in 2004 to a felony theft charge and in 2008 to a felony breaking-and-entering charge, according to Franklin County court records.
According to both Hackley, Kirk and Columbus police reports, Kirk, a dishwasher at Tip Top Kitchen & Cocktails, ran a red light at Front and Main streets and was struck by Robert Lagergren, who was driving DeWine back to his office.
Kirk was cited by the officer with city code 2113.01 for disobeying traffic control devices but not written a ticket. According to Sgt. Rich Weiner of the Columbus Division of Police, it’s at the officer’s discretion whether or not to actually give the person a ticket. In this case, he said, the officer wrote the citation for insurance purposes only to show who was at fault.
