Attempted Robbery in Victorian Village

Hi Friends --

I just wanted to put Victorian Village residents on alert. This morning, around 7 AM, I was getting into my car (I live right by Piercology, at 2nd ave and Hunter) and was approached at gunpoint by a man asking for my money.

Unfortunately, he got away (despite a neighbor's attempt to chase him) and as the guy was running away, he started taking off his sweatshirt and mask, and he was white and had a tattoo on his back. When he approached me, he had a black mask on and either goggles/sunglasses so I couldn't see his eyes, but he was about 5'8" 5'10" and of average build.

I just wanted to let people know so they can watch out/be careful when exiting their homes in the next couple of days.

@cheap: my neighbor was not armed -- i woke him (and probably most of my block, lol) because i was screaming at the top of my lungs. my neighbor ran out of his house and the guy ran past him, so he chased him down -- my poor neighbor was in his boxers!

i just wanted to let people know so they can be a little extra careful in the next couple of weeks. it was definitely a scary experience that i don't want anyone else to experience!

@Mercurius: thank you for the links, i will check them out and comment on this. the police filed a report but when the detective called me this afternoon she basically said there wasn't much they could do.

Someone stole a ladder from the front of my house while the roofers were working. Make sure you look up when leaving your home since the criminals now have a big ladder.

With a CCW, he wouldn't have gotten away. Hate to say it, but that's what it's coming down to. Crooks are way too brazen today and will do anything at anytime for a free buck. -Why does Alan Harper dislike me so?-

What would a bystander with a ccw have done? Shoot the guy? Most dont have the guts.. Also if the victim had a ccw what would they do? Pull it out and get shot or shoot them as they flee? Can you shoot a dangerous fleeing felon? idk.

If someone is trained and aren't afraid to use a gun that they have taken classes to carry, then yes to your questions. -Why does Alan Harper dislike me so?-

Not legally in this state as I understand things and the situation as described.

Deadly force may be used only to prevent serious bodily harm or death. Shooting a fleeing thief in the back doesn't qualify ( although, hypothetically, if the thief points a firearm at you it could ).

I may be fuzzy on OH CCW law but the only justifiable use in this case would be by the victim themselves when the threat was first presented. And at that point, with a gun already pointed at you, pulling a gun of your own is not going to be a smart decision.

Does Ohio still specify a duty to retreat? I believe we now have Castle Doctrine in the state on one's own property. Not sure about when it's a public space.

If the victim is in the car it would be legal to shoot the perp. I believe this was added to the castle law for car jackings.

Dwelling or vehicle, no duty to retreat. It's presumed that one acted in self defense, provided the attacker has no legal right to be in said dwelling / vehicle.
